KARNATAKA PROTECTION OF RIGHT TO FREEDOM OF RELIGION BILL 2021( A BILL WHICH VIOLATES THE ARTICLE 21 AND 25 OF THE CONSTITUTION)



The Karnataka Assembly has passed the controversial  bill of Anti-Conversion. I n this bill the converting into other religions is an offence now.

The bill contains clause`s as follows:

1. Any person found guilty of unlawfully converting another person will face a minimum jail term of three years to five years and fine of 25,000.
2. If the person `unlawfully converted` is either a minor or woman or belongs to the scheduled castes or scheduled tribes, the punishment is more a minimum sentence of three years and a maximum of ten years imprisonment, and  50,000 fine.
3. In cases of `mass conversion` the accused person can face three to ten years in prison and a fine of Rs, 1 lakh.
4. An appropriate court will order the accused person to pay compensation to the victim of conversion and this amount can go up to 5 lakhs and must be paid by accused over and above the fine under law.
5. In case someone wants to convert to another religion voluntarily, there is a lengthy process in place and this applies to inter-faith marriages too.


Background:

 States such a UP and MP have already passed this bills and Haryana and Karnataka are likely to do so.
Proponents say that this is a pan India racket and hence requires a central law.


The reasons behind it:
1. Threats of forceful conversion.
2. Problem of inducement or allurement.
3. Religious conversion is not a fundamental right.




How it violates the Article 21 and 25 of Indian constitution:

1. They have pointed to Article 21 of the constitution which guarantees individuals the right to marry a person of one`s choice.

2. Also, under Article 25, freedom of conscience, the practice the conversion of religion of one`s choice including not following any religion, are also guaranteed.

Swamy Nithyanand must be charged according to the bill.

What about him?

This is a nation which has  a constitution under that the whole country runs, and cannot be violated.
